- Die Arbeit untersucht die verfassungsrechtlichen Grundlagen der kommunalen Selbstverwaltung und ihrer finanziellen Ausstattung. Im Mittelpunkt stehen die Grenzen gesetzlicher Aufgabenübertragungen und Aufgabenausgestaltungen, der kommunale Finanzausgleich sowie das landesverfassungsrechtliche Konnexitätsprinzip. Sie vertritt die Auffassung, dass Art. 28 Abs. 2 GG neben einer institutionellen Garantie ein subjektives Recht der Kommunen auf eigenverantwortliche Regelung ihrer Angelegenheiten gewährleistet. Gesetzliche Eingriffe in dieses Recht bedürfen daher einer Rechtfertigung nach Maßgabe des Verhältnismäßigkeitsprinzips. Daraus folgt insbesondere, dass finanzielle Belastungen, die durch die Übertragung oder kostensteigernde Ausgestaltung kommunaler Aufgaben entstehen, auszugleichen sind. Für die Bestimmung einer finanziellen Mindestausstattung entwickelt die Arbeit die „Autonomiequote“ als Verhältnis der Ausgaben für freiwillige Selbstverwaltungsaufgaben zu den kommunalen Gesamtausgaben. Das Konnexitätsprinzip wird nicht als dauerhafte, finanzkraftunabhängige Finanzierung aller übertragenen Aufgaben verstanden, sondern als befristeter Sofortausgleich bis zur Anpassung des kommunalen Finanzausgleichs an die veränderte Aufgabenstruktur. Damit sollen die finanzielle Handlungsfähigkeit der Kommunen, die Schutz- und Warnfunktion des Konnexitätsprinzips sowie die Funktionsfähigkeit des kommunalen Finanzausgleichs zusammengeführt werden.

- This dissertation examines the constitutional foundations of local self-government and of the financial resources required for its effective exercise in Germany. Its focus is on the constitutional limits of statutory transfers and specifications of municipal tasks, on the system of municipal fiscal equalisation, and on the principle of fiscal connectivity (Konnexitätsprinzip) embedded in the constitutions of the Länder. The study argues that Article 28(2) of the Basic Law guarantees not only an institutional safeguard but also a subjective public right of municipalities to regulate local affairs on their own responsibility. Statutory interferences with that right therefore require justification under the principle of proportionality. In particular, financial burdens resulting from the transfer of tasks to municipalities or from cost-increasing statutory specifications of municipal tasks must be compensated. To determine a minimum level of adequate municipal funding, the dissertation develops the concept of an “autonomy ratio” (Autonomiequote), defined as the share of expenditure on voluntary self-government functions in total municipal expenditure. It further argues that the principle of fiscal connectivity should not be understood as a permanent, fiscally neutral reimbursement of all transferred tasks. Instead, it should provide immediate but temporary compensation until municipal fiscal equalisation has been adjusted to the changed allocation of tasks. This approach seeks to reconcile municipal financial autonomy, the protective and cautionary functions of the connectivity principle, and the continued functioning of municipal fiscal equalisation.
